No merit. The Design-Builder is responsible for the PSE power routing design to the Transit Hub under the contract. WSDOT determined no extra cost is warranted for temporary signal power design. No Change Order was issued. The DB’s cost claim reflects design effort to meet its own contractual obligations, not costs attributable to a WSDOT-directed change.
DRB position paper is in development. Key issues include: (1) whether the PSE routing change was within the DB’s design scope, (2) whether any WSDOT action constituted an OIC under GP 1-04.4(1), and (3) the basis for the 3× increase in AECOM’s cost estimate from initial ($340K) to supplemental ($514K).
